Our Mediation Services 

 

Mediation is the process of resolving problems.

 

The role of the mediator is not to judge or take sides. The mediators role is to facilitate the process and try to keep the doors of conversation open and productive until a mutual agreement can be reached.

 

Generally speaking, your mediator will have an initial meeting with you, your lawyer and the other party  involved  to obtain basic information and then explain the process of the session(s). Then, you will have a series of joint meetings, or possibly a single meeting in the attempt to resolve your conflict. You may also have separate meetings (caucus) where you and your attorney are in one room and the other party is in another room.

 

Your mediator will go back and forth with any offers that you might have, and try to negotiate a settlement. If you put together an agreement, the mediator will write the settlement down and submit the agreement to your judge for approval. Judges typically tend to approve mediation agreements.

Your participation in the mediation process is voluntary. You can leave whenever you like. However, a good mediator will try to help you resolve your concerns to keep you in the mediation process.

Mediation sessions are usually
confidential. As such, your discussions will not be recorded in court records. Any acrimonious statements that are made by either party will not be made public.

 

The opportunity to reduce the necessity to appear in court, as well as to save money by reducing the length of your litigation or resolution process. With the assistance of mediation, you and your party will have the power to make your own decisions, and eliminate the possibility of a judge or jury making the decisions for you. Mediation gives both parties the opportunity to have a positive outcome, where in a courtroom setting only one party will be awarded the ruling or judgment.

 

In summary: Mediation can be a more convenient, more comfortable way to resolve your conflicts, possibly saving you time and money and with the opportunity to have involvement in deciding your own resolution.
